These Terms of Service ("Terms") govern your use of the Three Forks Treasure Hunters Club ("TFTHC," "we," "us," or "our") website and your participation in our meetings, events, and National Hunt. By accessing our website or registering for any event, you agree to be bound by these Terms. If you do not agree, please do not use our website or participate in our events.
1. Eligibility
Membership and event participation are open to all individuals regardless of experience level. Minors under 18 may participate only with the written consent of a parent or legal guardian, who must also sign a liability waiver on the minor's behalf. Some events, such as kids-only hunts, have specific age requirements.
2. Event Registration and Payment
- Registration for the National Hunt and other paid events is completed through our online hunt store or by mailing the registration flyer.
- Payment is due in full at the time of registration unless otherwise stated.
- Refund and cancellation policies are outlined on the registration flyer and may vary by event.
- TFTHC reserves the right to cancel or reschedule events. In the event of cancellation, registration fees will be refunded or applied to a future event at the registrant's option.
3. SMS Terms and Conditions
By opting in to SMS text messaging from Three Forks Treasure Hunters Club, you agree to the following terms:
- Consent: You provide express written consent to receive automated SMS text messages from TFTHC at the phone number you provide. Consent is not a condition of any purchase.
- Program: Messages may include event reminders, meeting notifications, National Hunt updates, and general club communications.
- Frequency: Message frequency varies, typically up to 4 messages per month, with additional messages during National Hunt registration periods.
- Opt-out: Reply "STOP," "END," "CANCEL," "UNSUBSCRIBE," or "QUIT" to any message to opt out. You will receive one final confirmation message.
- Help: Reply "HELP" to any message for assistance, or email threeforksclub@gmail.com.
- Costs: Message and data rates may apply. Check with your wireless carrier for pricing details.
- Carriers: SMS service is available through participating U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, US Cellular, and others. Carriers are not liable for delayed or undelivered messages.
- Responsibility: You are responsible for ensuring the phone number provided is correct and that you are authorized to receive messages at that number.
- Privacy: Information collected via SMS is handled in accordance with our Privacy Policy.
4. Assumption of Risk and Liability Waiver
Metal detecting, treasure hunting, and related outdoor activities involve inherent risks including but not limited to uneven terrain, weather exposure, encounters with wildlife, sharp or buried objects, and equipment-related injuries. By participating in any TFTHC meeting, event, or hunt, you acknowledge that:
- You voluntarily assume all risks associated with participation.
- TFTHC, its officers, members, volunteers, sponsors, and property hosts are not liable for any injury, loss, or damage to person or property arising from participation.
- You are responsible for your own safety equipment, including appropriate footwear, gloves, and protective gear.
- For minors, the signing parent or legal guardian assumes all risks on behalf of the minor participant.
5. Code of Ethics and Legal Compliance
All participants agree to abide by the TFTHC Code of Ethics and applicable local, state, and federal laws, including:
- Land access: Always obtain express permission from property owners or land managers before metal detecting on private or public land. Trespassing is prohibited and grounds for removal from the club.
- Archaeological Resources Protection Act (ARPA): It is a federal crime to excavate, remove, damage, or alter any archaeological resource more than 100 years old on federal or Indian lands without a permit. Participants must not disturb known archaeological sites.
- Oklahoma Antiquities Law: State laws protect historical and archaeological sites on state lands. Detecting on state parks requires permits where applicable.
- Historic artifacts: Participants must not knowingly remove, damage, or destroy historic or prehistoric artifacts, human remains, or grave goods. Discovery of such items must be reported to the appropriate authorities.
- Fill your holes: All holes created during detecting must be properly refilled and the ground surface restored. Leave the area as you found it.
- Remove trash: Participants are encouraged to remove and properly dispose of any trash or debris discovered while detecting.
- Report significant finds: Significant historical finds should be reported to the club and, where appropriate, to state or local historical authorities.
6. Photo and Media Release
By attending TFTHC events, you grant TFTHC the right to photograph or video you and to use such media in promotional materials, newsletters, social media, and the club website without compensation. If you do not wish to be photographed, please notify an event organizer in advance. For minors, the signing parent or legal guardian grants this release on the minor's behalf.
7. Equipment and Finds
- Participants are responsible for bringing their own metal detecting equipment unless otherwise stated for a specific event.
- During organized seeded hunts (such as the National Hunt), all prize tokens and seeded coins must be recovered during the designated hunt period to be eligible for prizes.
- Found items on private property belong to the property owner unless otherwise arranged. TFTHC facilitates the return of lost personal items to their owners whenever possible.
- TFTHC does not appraise, authenticate, or guarantee the value of any recovered item.
8. Website Use
- You agree to use our website only for lawful purposes.
- You may not attempt to disrupt, damage, or gain unauthorized access to the website or its underlying systems.
- All content, including text, images, logos, and design, is the property of TFTHC or its licensors and may not be reproduced without permission.
9. Sponsors and Third-Party Links
Our website and events may feature sponsor logos and links to third-party websites. TFTHC is not responsible for the content, products, or services of third parties. Sponsorship of TFTHC events does not constitute an endorsement of any product or service.
10. Limitation of Liability
To the fullest extent permitted by law, TFTHC, its officers, directors, members, volunteers, and sponsors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the website or participation in any club activity.
11. Indemnification
You agree to indemnify and hold harmless TFTHC, its officers, directors, members, volunteers, and sponsors from any claims, damages, or expenses arising from your use of the website, your participation in events, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Oklahoma without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Wagoner County, Oklahoma.
13. Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the website or participation in events after changes are posted constitutes acceptance of the revised Terms.
